Mongolian Courts may apply Foreign Laws

When required, Mongolian Courts may apply Foreign Laws in resolving of civil disputes.

 

The availability of this option is set out in Section 540 of the Civil Code of Mongolia.

 

Foreign laws will include regulations or proclamations (or the so-called legislative norms).

 

In addition, Mongolian Courts can apply internationally accepted customary norms.

 

Please note, however, that Foreign Laws and customary norms must be consistent with the Constitution of Mongolia, laws enacted by the Parliament and international treaties signed by Mongolia.
