LAW ON THE LEGAL STATUS OF FOREIGN NATIONALS (2010)

  1. Background

This Law on the legal status of foreign nationals regulates the legal status of foreign nationals and their residence, entry into and exiting from Mongolia.

Mongolia employs reciprocal policy when regulating the rights, and duties of foreign nationals.

In the interests of Mongolia’s independence, national security and social order, the rights and freedoms of foreign nationals may be restricted by law without violating inalienable human rights of foreign nationals. In all other respects, foreign nationals enjoy the same rights, freedoms, and duties as Mongolian nationals do enjoy.

  1. Rights enjoyed by foreign nationals

A foreign national, enjoys, among other things, the right to:

  • request a political asylum in Mongolia
  • work at the highly critical facilities of the country as permitted by the Mongolian Government (the GoM)
  1. Duties and obligations of foreign nationals

-Pay taxes in accordance with Mongolian laws

-Comply with the Constitution, and other laws of Mongolia

-Get registered with the government organization in charge of foreign nationals within seven (7) days of entry into Mongolia

-Respect traditions and customs of Mongolian people.

-Foreign nationals are prohibited from participating in political actions, or finance political activities

-Work in Mongolia without permission granted by a competent authority, or advertise or use drugs.

  1. Visas

There’re 11 types of visa categories. Visas are issued by the Ministry of foreign affairs, the government agency in charge of foreign nationals, and diplomatic representatives or consulates of Mongolia.

The time period for residence in Mongolia are a/ 90 days for a temporary visitor; b/10 days for a transit visitor, and c/ indefinite period or until the issuance of a residential permit for those residing in Mongolia for official or personal reasons.

The following reasons are considered residing in Mongolia for personal reasons:

  • Family reasons
  • Immigration
  • Employment
  • Investing in Mongolia
  • Study, professional advancement training, or research works.

  1. Deportation

Among other things, a foreign national will be deported if:

  • A fake document is used for an entry to Mongolia
  • Avoids exiting the country at the expiry of a residential permit
  • Violates visa and registration rules two or more times
  • Works in Mongolia without a permit given by a competent authority
  • Engages in activities different from the purpose of arrival in Mongolia
